The General Contracting Conditions regulate the distance selling relationship between BALKANICA DISTRAL SL and his clients, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Contracting Conditions, Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, current and applicable regulations on the General Data Protection Regulation (GDPR), Law 7/1996, of January 15, of Ordination of the Retail Trade, and Law 34/2002, of July 11, of Services of the Information Society and Electronic Commerce (LSIS-EC).

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal.

BALKANICA DISTRAL SL only makes shipments in Iberian Peninsula, Balearic Islands, Canary Islands and France. The shipping costs will be applied depending on the shipping area, size, weight, and measurements of the product. The customer can see these costs before finalizing the buy.

The estimated delivery time of the products is 24/48 hours for shipments on the Peninsula, France and the Balearic Islands. For the Canary Islands, the deadline will be a maximum of 7 days.

Forms of payment and execution of the order

The client can pay the amount of his/hers order by choosing any of the following forms. During the buy process he/she must indicate the choice:

When the amount of a buy has been charged fraudulently or improperly using the number of a payment card, the holder may demand the immediate cancellation of the charge. In such case, the corresponding debit and debit entries in the accounts of the provider and the holder shall be made as soon as possible.

However, if the buy had actually been made by the cardholder and the refund requirement was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had unduly demanded the cancellation of the corresponding charge, that will remain obliged to BALKANICA DISTRAL SL to compensate the damages and losses caused as a result of the cancellation.

- Bank transfer

When you selecting the bank transfer you will receive, along with the confirmation of your order, an e-mail with banking information of BALKANICA DISTRAL SL.

It is very important that when you making the transfer indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days after the date of confirmation of the order to validate it.

Remember that the payment has to be made in EUROS and that all possible exchange and banking commissions run on their own.

In the case of bank transfers made from outside Spain, it is very important that when you order the transfer always inform your bank to take charge of the commissions at source, those bank commissions and expenses corresponds to your entity.

Possible exchange and banking commissions are charged to the client.

The availability of the products offered by BALKANICA DISTRAL SL may vary depending on the demand of the clients. Although BALKANICA DISTRAL SL updates the stock periodically, the product requested by the client could be sold out at that moment. In the event of non-execution due to unavailability, BALKANICA DISTRAL SL will notify the client by email at the time they have knowledge of this situation. The period of this communication will not exceed in any case the maximum period of 30 days. In these case, BALKANICA DISTRAL SL may offer two options: supplying the client without price increase, a product with similar characteristics or of superior quality, or to pay the amounts paid for the canceled order. Right of withdrawal, returns and claims

The buyer will have fourteen calendar days to desist, from the day he/she receives the product, without any penalty and without indication of the reasons.

The exercise of the right of withdrawal must be made by notification by telephone, by sending an e-mail to lopd@balkanica.es, sending your letter to our address C/ HORT DEL PORTUGUÉS, 1 CP 46800, XÀTIVA (VALENCIA), or through the withdrawal form.

As established in article 103 of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, the supplies of services or goods made according the specifications of the client or personalized products, or that, by their nature, can not be returned or may deteriorate or expire quickly, are exempt from withdrawal.


Return

BALKANICA DISTRAL SL will be responsible for collecting the product.

The client must return or deliver the product directly to BALKANICA DISTRAL SL, at the address C/ HORT DEL PORTUGUÉS, 1 CP 46800, XÀTIVA (VALENCIA), without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right to cancel the contract is formalized. The term will be considered fulfilled if the client makes the return of the product before the end of that term.

BALKANICA DISTRAL SL will be responsible for the costs of the return.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Please, therefore, that in order to avoid transport problems, make sure that the package is properly protected and sealed. Once received, we will check his status. At the time that we check both the products, as well as the possible components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to return the money paid.


Payment refund

The reimbursement of the amounts received by the client will be made using the same means used by him/her, as long as the opposite has not been provided.

BALKANICA DISTRAL SL may withhold reimbursement until the products has been received, or until the client provides proof of the return.

In case of unjustified delay by BALKANICA DISTRAL SL, the client can claim twice the amount paid, without prejudice his/hers right to be compensated for the damages suffered.


Return of defective product

In the event that the product is not in good condition and the causes attributable to it, are not result of the client, he/she can return it, informing BALKANICA DISTRAL SL for the reason to return through any of the means provided in these General Contracting Conditions, and at no cost for the client. This return due to defect or poor condition of the product will not be considered a withdrawal.

BALKANICA DISTRAL SL undertakes to assume the cost of the return and to change it for a new one in accordance with conditions accepted at the time of the sale.

Jurisdiction

The relationship between the user and the provider will be governed by the regulations in force and applicable in Spanish territory. If any dispute arises, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
